General terms and conditions
I. Scope
The General Terms and Conditions as amended from time to time (hereinafter referred to as GTC) are the subject matter of the contract between DonauGuides GmbH, which operates the platform austriaguide.at, and those natural persons and legal entities that are registered on the internet platform Regiondo.de as “leisure providers” and wish to present offers.
II. subject
The possibility of presenting all types of offers under the General Terms and Conditions (GTC) listed here is open to all tourist guides.
austriaguide.at does not itself become a contractual partner to the service contracts concluded exclusively between providers and interested parties of this marketplace. The fulfillment of these service contracts initiated and/or concluded via the platform also takes place exclusively between the users.
III. Registration
For tourist guides, offers are presented, on the current page via appropriate links and for an agency commission. The provider of the offer is responsible for the content. The brokerage commission can be viewed accordingly in the Regiondo provider account in the “Channel Manager” section > “Sales Channels”.
By activating his/her advertisement, the provider expressly confirms that the publication can be carried out in the form and that he/she agrees with it without restrictions.
With the registration, a contract for the use of the platform (hereinafter: contract of use) is concluded between DonauGuides GmbH and the provider. DonauGuides GmbH is free to reject an application without giving reasons. There is therefore no entitlement to the presentation of web content or offers on the austriaguide.at platform.
IV. Intermediary of leisure, sports and vacation offers
The provider undertakes to only post serious content and to carefully and truthfully compile the information provided to austriaguide.at about the offer and to deactivate it immediately if the offered object is no longer available. The provider is solely responsible for the content and accuracy of the data provided. He undertakes not to transmit any data whose content infringes the rights of third parties or violates existing laws, in particular copyright, competition and trademark laws. The provider shall indemnify and hold DonauGuides GmbH harmless from and against any and all claims asserted against DonauGuides GmbHJ by third parties due to such violations, including any legal representation costs incurred in connection with the defense against such claims.
V. User contract, liability
myosttirol.at provides users with an online sales channel in exchange for a commission. The amount of the commission percentage can be seen in the provider account on Regiondo.de. The sales channel austriaguide.at must be selected and activated by the provider himself in his Regiondo user account under “Sales channels”. He then has to select and activate offers for this sales channel. The activation is only checked by DonauGuides GmbH.
DonauGuides GmbH or austriaguide.at is not liable for interruptions, malfunctions, delays, deletions, incorrect transmissions or a memory failure in connection with the use of the service.
No liability is assumed for the correctness of the content of the information provided and no guarantee is given for the correctness, completeness and up-to-dateness of the data. Any liability of DonauGuides GmbH or austriaguide.at due to incorrect and faulty information by users of the internet service is excluded. Users are also responsible for which links they use.
All users of this platform undertake to indemnify and hold austriaguide.at harmless.
VI. rights of use, data protection
The provisions of data protection in the currently valid version of the Data Protection Act are complied with.
By setting or feeding in data, the user grants austriaguide.at the right to store and process the data provided by him, including personal data, within the limits of the Data Protection Act for the purpose of providing the services offered by it. By entering his user data, the user expressly agrees to be informed by DonauGuides GmbH or austriaguide.at for the purpose of advertising and arranging activities and related services by telephone, fax, e-mail, SMS, etc.. In particular, he also agrees to the transfer of his personal data to third parties, insofar as this is necessary for the processing of contracts concluded between suppliers and interested parties via the austriaguide.at website.
Consent may be revoked by the user at any time (Section 101 of the Telecommunications Act).
VII. other
These GTC are subject to Austrian law in their entirety. The place of jurisdiction is Vienna.
DonauGuides GmbH reserves the right to change these GTC at any time and without giving reasons. The amended terms and conditions shall be sent to members by e-mail no later than two weeks before they come into force. If a member does not object to the validity of the new GTC within two weeks after receipt of the e-mail, the amended GTC shall be deemed accepted.
The invalidity or ineffectiveness of individual provisions of the GTC shall not affect the validity or enforceability of the remaining provisions. The invalid or unenforceable provision shall be replaced, if necessary, by a valid or enforceable provision that comes as close as possible in its economic content to the invalid or unenforceable provision; any loopholes shall also be closed in this way.
